At Wang Law LLC, we assist lawful permanent residents in obtaining U.S. citizenship through naturalization. U.S. citizens enjoy permanent residency, voting rights, and the ability to sponsor family members for immigration. If you are considering naturalization, this guide outlines the eligibility requirements, application process, and how our firm can help.

Ways to Obtain U.S. Citizenship

U.S. citizenship can be acquired through:

  1. Birth – Automatically granted if born in the U.S. or certain U.S. territories.
  2. Derivation – Children may acquire citizenship through their U.S. citizen parents.
  3. Naturalization – The process by which lawful permanent residents (Green Card holders) apply to become U.S. citizens.

Once obtained, U.S. citizenship is permanent and cannot be lost due to extended travel abroad.

Eligibility Requirements for U.S. Citizenship

To qualify for naturalization, an applicant must generally meet the following requirements:

  • Be a lawful permanent resident (Green Card holder) for at least 5 years (or 3 years if married to a U.S. citizen and living together for those 3 years).
  • Have been physically present in the U.S. for at least 50% of the required residency period.
  • Demonstrate good moral character during the required residency period.
  • Be proficient in basic English (reading, writing, and speaking), though exceptions exist for certain age groups and medical conditions.
  • Pass a U.S. history and civics test on American government and historical knowledge.
  • Take an Oath of Allegiance to the United States.

Certain military service members may qualify for an expedited naturalization process under special provisions.

The Naturalization Process

The naturalization process consists of several steps:

  1. Determine Eligibility – Verify if you meet the residency, physical presence, and moral character requirements.
  2. Prepare Form N-400 – Complete Form N-400 (Application for Naturalization) and gather required supporting documents.
  3. Submit Form N-400 – File your application with U.S. Citizenship and Immigration Services (USCIS) and pay the required fee.
  4. Biometrics Appointment – Attend a fingerprinting appointment (if required) for background checks.
  5. USCIS Interview & Citizenship Test – Answer questions about your application and take the English and U.S. civics test.
  6. USCIS Decision – Receive a decision on your application. Approval is required before moving to the next step.
  7. Oath of Allegiance – If approved, attend a naturalization ceremony and take the Oath of Allegiance to officially become a U.S. citizen.
  8. Receive Certificate of Naturalization – After taking the oath, you will receive your Certificate of Naturalization, proving your U.S. citizenship.

U.S. Citizenship Test

As part of the naturalization interview, applicants must pass a test on U.S. history, government, and civics. You must answer at least 6 out of 10 questions correctly to pass.

Some applicants may qualify for exemptions or accommodations based on age, disability, or long-term residency status.
